temporary employment from abroad

Zeitarbeit International - legal challenges

German companies rely on employing foreign skilled workers in many industries. Not least in industry and trade, skilled workers are urgently needed on a flexible basis. The IT industry, automotive engineering, production and manufacturing are also faced with staff shortage problems. German companies are always dependent on the support of external - often foreign - workers.

Temporary employment from abroad enables companies to rely on qualified workers and support staff from abroad without employing them directly. Instead, the workers are hired by a temporary employment agency and “loaned” to the company. This is particularly useful if you need additional workers at short notice.

Why temporary employment from abroad?

The shortage of skilled workers in Germany is an ongoing problem, especially in industries with high demand for specialized workers such as engineers, IT specialists and nursing staff. The Temporary Employment Act (AÜG) enables German companies to use temporary workers from abroad to combat this shortage.

Temporary employment from abroad offers companies a number of advantages and is used for various reasons. An important reason is flexibility. Companies can respond quickly to fluctuating work demands by using temporary workers from abroad. This enables them to bridge bottlenecks, compensate for seasonal peaks or make use of special expertise at short notice.

Furthermore, temporary employment from abroad offers access to a broader talent pool. Companies can access highly qualified specialists from different countries who have specific skills and experience that may not be available in their own country. This is particularly important in industries with a shortage of skilled workers or in specialized areas.

Overall, temporary employment from abroad offers companies the opportunity to react flexibly to work requirements, gain access to talent, reduce costs, open up new markets and promote diversity in the workplace.

Cross-border temporary employment - advantages

  1. Flexibility and scalability: thanks to the possibility of deploying employees from abroad, companies can flexibly and quickly deploy additional workers for projects or seasonal peak periods and reduce them again if necessary.

  2. Access to a larger talent pool: Cross-border temporary employment gives companies access to a broader talent pool. You can recruit skilled workers from abroad who have specific skills and experience that may not be available in your own country.

  3. Cost efficiency: In some cases, cross-border temporary employment can be cost-effective. This is particularly true in countries with lower wages and living costs. This allows companies to reduce personnel costs.

  4. Specialized expertise: companies can access specialized professionals across borders who are particularly in demand in certain countries or regions and can use them to carry out projects that require specific expertise.

  5. Market development and global presence: through cross-border temporary employment, companies can send employees to foreign markets to build business relationships, serve customers and gain local knowledge.

  6. Cultural exchange and diversity in the workplace: working with workers from abroad promotes cultural exchange and diversity in the workplace. Companies can benefit from different perspectives, ways of working and ideas, which can promote innovation.

International AÜG - legal basis

There are 3 basic constellations of international temporary work:

Temporary employment abroad from Germany

Temporary employment abroad from Germany is subject to certain legal peculiarities and regulations. Here are some important aspects to consider:

  1. Legal basis:

In Germany, the Temporary Employment Act (AÜG) regulates this. If German employees are deployed abroad, the labor laws of the target country must also be taken into account.

  2. Visa and work permit:

Employees who are sent abroad often require visas and work permits. This varies depending on the country and the respective immigration regulations.

  3. Social security and taxes:

It is important to check the impact on social security and tax obligations, both in Germany and in the destination country. Double taxation agreements can help to avoid double taxation.

  4. Local labor laws and collective agreements:

The local labor laws and collective agreements in the destination country must be observed. These can differ greatly from German regulations.

  5. Equal Treatment:

The principles of equal treatment should also be observed when transferring employees abroad. This includes wages, working conditions and other benefits.

  6. Occupational health and safety and employee rights:

The occupational health and safety regulations and employee rights in the destination country must be respected. This can include both legal regulations and cultural norms.

Deployment of foreign temporary workers to Germany

EU citizens

If temporary workers from abroad are to be transferred to Germany or employed directly in Germany, there are a number of requirements that must be met. Workers from EU countries can be deployed without major hurdles. They enjoy full freedom of movement for workers. For this reason, EU citizens can also work as temporary workers in Germany.

Non-EU citizens / third-country nationals

Cooperation with employees from non-EU countries is more difficult. In this case, the individual residence permit, which may include a work permit, is decisive. The residence permit can only be issued with the approval of the Federal Employment Agency.
